BY ENTERING (OR OTHERWISE PARTICIPATING) IN THE SWEEPSTAKES, YOU AGREE TO THESE OFFICIAL RULES, WHICH CREATE A CONTRACT, SO PLEASE READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, SUCH CONTRACT INCLUDES A CLASS ACTION WAIVER AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.

PROMOTION OVERVIEW: Versiti’s Butler vs. Marquette Blood Battle Coffee Shop Gift Card Sweepstakes (the “Sweepstakes”) consists of six separate drawings. Three of the drawings will be held among all entrants from designated Butler vs. Marquette Blood Battle blood drives taking place in Indiana, with the drawings taking place near the end of each month in the Fall Semester. Similarly, three drawings will be held among all entrants from designated Butler vs. Marquette Blood Battle blood drives taking place in Wisconsin, with the drawings taking place near the end of each month in the Fall Semester.

ELIGIBILITY: The Sweepstakes is open to legal U.S. residents who are 18 years of age or older at the time of entry and have reached the age of majority in their respective states of residence. The following are not eligible: (i) employees, officers, directors, agents, independent contractors, and representatives of Sponsor and its respective parents, affiliates, subsidiaries, wholesalers, retailers, distributers, advertising, and promotion agencies; (ii) senior leadership of entities or organizations with contractual agreements in place with Versiti for blood-related products or services, as well as employees of such entities or organizations who had or have responsibility for negotiating such contractual agreements; and (iii) the immediate family members (mother, father, sister, brother, husband, wife, daughter, son, step-father, step-mother, step-daughter, step-son, step-brother, step-sister, half-brother, half-sister) and/or those living in the same household of any persons under (i) and (ii) above. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void where prohibited or restricted by law or regulations. Participation constitutes entrant’s full and unconditional agreement to these terms and conditions and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes.

SWEEPSTAKES PERIOD: The Sweepstakes consists of six separate drawings, with beginning and ending entry dates and drawing dates as detailed in the table below.

Interested participants may enter each of the six separate drawings, as described below. Please note that non-winning entries from one drawing will not roll-over to the subsequent drawings.

HOW TO ENTER: There are two ways to enter the Sweepstakes: (1) by donating or attempting to donate blood at a Versiti BU v MU Blood Battle blood drive (a “Blood Drive”) located in Wisconsin or Indiana during the Sweepstakes Period; or (2) by submitting an online Sweepstakes entry during the Sweepstakes Period. The choice of entry method will not affect an entrant’s chances of winning.

1. To enter by donating: To enter into the Butler (Fall) drawings, donate or attempt to donate at a Blood Drive taking place in Indiana during the Sweepstakes Period listed above. To enter into the Marquette (Fall) drawings, donate or attempt to donate at a Blood Drive taking place in Wisconsin during the Sweepstakes Period listed above. (For locations and dates of the Blood Drives in Indiana and Wisconsin, please visit Versiti.org/BUVSMUBB.) Donors will be tracked by Sponsor and will be automatically entered into the respective drawing after their donation. Specifically, eligible entrants who donate during the Sweepstakes Period will receive one (1) entry into the applicable drawing. To be a donor, individuals must meet the minimum qualifications to donate. (Please visit Versiti.org for donor requirements.)
2. To enter without donating (“AMOE”): Eligible entrants may enter the Sweepstakes without a blood donation by doing the following: Visit Versiti.org/Coffee and fill out the entry form online during the Sweepstakes Period. You will be asked to state whether you want to receive an entry into the respective Butler or Marquette drawing. By completing the online form, you will receive one entry into the drawing that you have selected.

Limit one entry per person for each drawing, regardless of method of entry. Any attempt by an entrant to obtain more than the stated number of entries by using multiple/different addresses or any other methods will void that entrant’s entries and that entrant may be disqualified from the Sweepstakes. Entries submitted by anyone other than the entrant are void. Sponsor will not verify receipt of entries for entrants. All entries submitted become the sole property of Sponsor and will not be returned. Sponsor is not responsible for lost, late, misdirected, illegible, damaged, or postage-due mailed entries.

PRIZE AND APPROXIMATE RETAIL VALUE (“ARV”):  One entrant will be selected as the potential winner for each of the four drawings. The potential winner will receive the prize below:

• Butler (Fall 1) Drawing Winner: One (1) $60 Java House gift card (ARV: $60).
• Butler (Fall 2) Drawing Winner: One (1) $60 Java House gift card (ARV: $60).
• Butler (Fall 3) Drawing Winner: One (1) $60 Java House gift card (ARV: $60).
• Marquette (Fall 1) Drawing Winner: One (1) $60 The Brew gift card (ARV: $60).
• Marquette (Fall 2) Drawing Winner: One (1) $60 The Brew gift card (ARV: $60).
• Marquette (Fall 3) Drawing Winner: One (1) $60 The Brew gift card (ARV: $60).

Winning a prize is contingent upon fulfilling all requirements set forth herein. Gift cards subject to terms and conditions. PLEASE NOTE: Taxes on prize are the sole responsibility of the winner. Affidavit of eligibility (including SSN), prize acceptance form, tax information, assignment of rights, publicity release, and/or mutually acceptable liability releases may be required where not prohibited. Prizes are awarded without warranty of any kind from Sponsor, express or implied, without limitation, except where this would be contrary to federal, state, provincial, or local law or regulation and, in such case, the prizes are subject to the manufacturer’s and/or service providers’ terms and conditions, and the winners agree to look solely to such manufacturers and/or service providers for any warranty or guarantee claim. No substitution or cash equivalent is allowed except in Sponsor’s sole discretion. Prize is not transferable, except that any winner, regardless of age, may transfer prize to a parent or legal guardian. Sponsor reserves the right, but not the obligation, to substitute a prize of the same or equal approximate retail value. For prizes of $600 or more in value to an individual winner in a calendar year, winner’s social security number or taxpayer ID will be required in order to issue a Form 1099-MISC showing prize ARV as income to winner. Prize consists only of items specifically listed as part of the prize. All costs and expenses not specified herein, related to any prize, are the sole responsibility of the winner.

ODDS OF WINNING, WINNER SELECTION, AND NOTIFICATION: Odds of winning depend on the number of eligible entries received for each separate drawing.

The potential winners will be selected randomly. Each potential winner will be notified via phone and/or email on or about the applicable drawing date (using information provided to Sponsor or via the online entry form) to verify his/her eligibility and ability to accept the prize, and to obtain his/her complete contact information. Any such message will instruct the potential winner to reply as specified within five (5) full business days after the time that the message was left or sent. Potential winner must reply as instructed to identify him/herself, confirm his/her eligibility and ability to accept the prize, and provide his/her complete contact information within such five (5) full business day period, or he/she will be disqualified. If requested by Sponsor, each potential winner may be required to complete an affidavit/certification of eligibility, a liability release, and (where permitted) a publicity release, which must be returned within the time period specified by Sponsor at the time of such request. Proof of identity, age, and legal residence may be required to claim a prize. Any winner or potential winner may be disqualified in Sponsor’s sole discretion if: (a) he/she fails to reply or to provide any required information or properly completed documents within the required time period; (b) he/she fails to comply with any of the terms of these Official Rules; or (c) if any prize or prize notification is returned as undeliverable. In the event of disqualification of any winner, at Sponsor’s sole discretion, the prize may be awarded to an alternate winner selected from among the remaining applicable eligible entries via the means of winner determination described herein, pending verification of eligibility. If any prize remains unclaimed after three (3) potential winners have been notified for that prize, the prize may remain unawarded, in Sponsor’s sole discretion. No responsibility is assumed by Sponsor for any incorrect or missing contact information associated with an entry, or for any change of contact information of entrant after entry submission. Upon winner confirmation, Sponsor will provide information to winner on delivery of prize.

PUBLICITY RELEASE: Except where prohibited, acceptance of the prize constitutes winner’s consent that his or her name, likeness, voice and/or biographical data may be used for advertising and promotional purposes without limitation and without additional notice, compensation, or consent.

RELEASE: By entering, entrant agrees to accept and abide by the Official Rules of this Sweepstakes and agrees that any dispute with regard to the conduct of this Sweepstakes, rule interpretation, or award of prize shall be submitted to Sponsor, whose decision shall be binding and final. By participating, entrant agrees to release and hold harmless Sponsor, Butler University, Marquette University, and their respective parent companies, affiliates, subsidiaries, service agencies, independent contractors, and the officers, directors, employees, agents and representatives of any of the above organizations (“Releasees”) from any injury, loss or damage to person, including death, or property due in-whole or in-part, directly or indirectly, to the acceptance or use/misuse of a prize, participation in any Sweepstakes-related activity, or participation in the Sweepstakes. Entrant hereby agrees to defend, indemnify, and hold harmless Releasees against any and all third-party claims, damages, liabilities, costs and expenses, including reasonable legal fees and expenses, arising out of or related to any breach by the entrant of any provision of this document, including, without limitation, entrant’s representations and warranties.

ADDITIONAL RULES: Sponsor is not responsible for any typographical or other error in the printing of this offer, administration of the Sweepstakes, or in the announcement of a prize, including erroneous appearance of qualification for the prize, and under no circumstances will more than the stated number of prizes be awarded. Sponsor reserves the right, in its sole and absolute discretion, to modify, cancel, or suspend this Sweepstakes, or to amend the Official Rules at any time, without prior individual notice, should any factor interfere with the administration, security, or proper play of this Sweepstakes as contemplated by these Official Rules. If for any reason Sponsor is prevented from continuing with this Sweepstakes, or the integrity and/or feasibility of the Sweepstakes is severely undermined by any event including but not limited to fire, flood, epidemic, pandemic, earthquake, pandemic, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, any federal, state, or local government law, order, or regulation, or any order of any court or jurisdiction, Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel, or terminate the Sweepstakes without further obligation. If Sponsor in its discretion elects to so abbreviate the Sweepstakes, Sponsor reserves the right, but not the obligation, to award the prizes from among all eligible entries received to date.

DISPUTES / CHOICE OF LAW: Except where prohibited, each entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this SWEEPSTAKES or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in WISCONSIN, (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees, (3) no punitive, incidental, special, consequential, or other damages, including without limitation, lost profits, may be awarded (collectively, “Special Damages”), and (4) entrant hereby waives all rights to claim Special Damages and all rights to such damages multiplied or increased. WISCONSIN law, without reference to choice of law rules, governs the SWEEPSTAKES and all aspects related thereto.

PRIVACY: As a condition of entering the Sweepstakes, each entrant agrees that personally identifiable information submitted as part of an entry will be used to administer the Sweepstakes, select the winners, and fulfill the prizes. Such information may be shared with Sponsor’s agents and affiliates as necessary to administer the Sweepstakes and fulfill the prizes. Information will be treated in accordance with Sponsor’s Privacy Policy available at www.versiti.org/privacy-policy.
